Defendants argue that (a) New Hampshire law provides the applicable statute of limitations, (b) that statute is the three-year statute for personal actions, RSA 508:4, and not, as plaintiff maintain, the twenty-year statute for and contracts under seal, RSA 508:5, and (c) this action was filed after the three year limitation period. For the reasons set forth below, the court agrees with defendant that RSA 508:4 is the applicable statute of limitations and that it expired before this action was filed.
