Any person who violates the provisions of RSA 270:25, 270:37, or 270:40, or any person who owns a boat which is operated with his permission or assent in violation of RSA 270:25, 270:37, or 270:40 shall be guilty of a violation for a first offense and guilty of a misdemeanor for a subsequent offense within a calendar year.
